MINE ID # OR PROSPECTING ID #: na-107R-2R3 <br />INSPECTION DATE: s-~ 3-n2 INSPECTORS INITIALS: _~- <br />The Division conducted apre-operational inspection of the site on 5-14-02. The site is being converted from <br />110 to a 112, construction materials permit. Present during the inspection was Mr. Joe Gagliano the <br />consultant to the operator. According to the conversion application, due to the operator processing material <br />from other sources, the concrete batch plant and all processing areas are not covered with in the permit <br />area. <br />The entire converted area was walked, driven and inspected; the appropriate boundary markers and <br />conversion application notice was posted in accordance with the rules and regulations. The area being <br />proposed to be mined with the exception of several acres to the North West of the existing permit, are all <br />with in a dry Arroyo. The operator had suggested that since all the mining is with in this dry Arroyo and that <br />since the site has been mined like this pre-law, they felt there would be no need to post a financial <br />warranty. However, the Division explained that even though it is a dry Arroyo, the embankments would <br />need to be stabilized. Given the length of the embankment for the operation approximately 5,000 feet, the <br />Division would calculate what it would take to cut the embankment slopes to minimize sever erosion. <br />Operator's representative agreed to post the appropriate warranty to stabilize the embankments as <br />calculated by the Division. <br />Associated with the existing operation, there was a small pond that the operator uses to wash the fines. <br />Operator according to the permit has the appropriate water rights. It appears from the cursory review of <br />the existing permit area, the operator might have disturbed more than 10 acres. Since the conversion <br />application is submitted which includes all of the affected areas, the Division will not take action.
