III. Comments -Compliance <br />Below are comments on the inspection. The comments include discussion of <br />ouservations made during the inspection. Comments also describe any <br />enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />2) Also, the 6 inch culvert at the loadout under the conveyor must be <br />permitted. <br />3) At the loadout there is a small bermed portion of disturbed area located <br />west of the railroad tracks that will require It to be routed to the <br />sediment pond. This area is about 8' by 12'. Rule 4.05.2(1) requires runoff <br />to flow to a sediment pond or treatment facility. A small pipe or clearing <br />under the railroad ballast should be made to allow flow to the pond. <br />4) During the past year the mine has had several discharges from ponds D, E <br />and F that have exceeded State and Federal water quality standards for <br />suspended solids. These may have occurred because of precipitation <br />events. If the mine wishes to claim a precipitation exemption for <br />suspended solids, the mine must show that the pond received precipitation <br />runoff within 48 hours of the discharge. Therefore, the Division is <br />requesting that the Marr Strip keep records of precipitation and runoff to <br />qualify for the exemption, otherwise discharges that do not meet State and <br />Federal water standards violates Rule 4.05.5(1)(b). <br />All drainage control structures that exist on the ground, but not In the permit <br />document will be addressed in the drainage control violation (NOV C-93-022) <br />written as a result of this inspection. <br />Maintenance Concerns: <br />The following are maintenance concerns that should be corrected when weather <br />permits. <br />1) The inlet to pond A was downcutting. This ditch should be regraded when <br />weather permits. <br />2) The hay bails at sediment sumps at the outslopes to ponds A and B had <br />been eaten by elk; they should be replaced when conditions permit. <br />3) The coal fines on the eastern portion of the loadout that had blown off the <br />coal stockpile. This should be raked up. <br />4) The loadout entrance sign was not at the permit boundary to the loadout. <br />This sign was moved before the end of the inspection. <br />5) At the loadout there are 2 barrels, one next to the north storage shed and <br />the other next to the oil storage area that should be placed In a protected <br />area if they are full. <br />6) At the mine site, the lower section of ditch 5 was silting in, this will <br />require retrenching when conditions permit. <br />7) All non-coal waste located at the loadout should be properly disposed. <br />Marr Strip p April 6, 1993 <br />
