The problems should be corrected by the dates given, or they will become possible violations. The possible <br />violations should be corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation <br />Board. The inspector noted on the previous page should be notified of all corrective actions taken. <br />PROBLEMS/POSSIBLE VIOLATIONS <br />AND <br />CORRECTIVE ACTIONS <br />Mining activities have affected approximately 2 acres beyond the permit <br />boundary with off-site material stockpiles. The Division believes this is a <br />violation of Construction Materials Rule 3.1.5(3) and Section 34-32.5- <br />116(4)(1) CRS of the Construction Materials Act, which states that areas <br />outside of the affected land shall be protected from damage occurring <br />during the mining operation and reclamation. <br />coRRECTIVE ACTION: The Division has scheduled the issue for <br />consideration by the Mined Land Reciamation Board during the Board's <br />March 14-15, 2007 meeting at 1313 Sherman Street, Room 318, <br />Denver, CO 80203, beginning at 9:00 am or as soon thereafter as the <br />issue can be considered. The Operator will have the opportunity to be <br />herd.
