(MCC) submits the enclosed amendment to the Dry Fork and <br />Lions Mesa Notice of Intent to Explore, submitted April 20, 2005, and subsequently amended <br />November 16, 2005. This 2nd amendment addresses the CDMG's Completeness Responses of 23 <br />November 2005. <br />Attached is information that clarifies the ownership and right-of--entry for the road and storage area. <br />The FigurelA was refined to better display the correct location of the storage/laydown azea, and the <br />as--'ouilt diagram was updated to show sediment control features. The calculations are provided that <br />show the pad size (0.48 acre) excluding the road right-of--way. The culverts and sizing is also <br />included on the diagram. <br />Mountain Coal Company L.L.C. is unawaze of who placed the culverts beneath the road, however, <br />as part of MCC's road use permit with the USFS, MCC maintains the ditches and culverts. <br />The area has been signed and MCC affected azea boundary signs have been placed at the area. <br />Topsoil was not salvaged as this azea has been historically used as a parking ]ot for recreational <br />ATVs, RVs, sledding, and recreational enthusiasts as evidenced by the USFS road easement. <br />What appears to be a road progressing to the south up a very steep incline is the sledding hill that <br />chazacteristically supports snowmobile traffic, sleds, and toboggans. <br />The portapotty was moved to the bermed area for containers. <br />We appreciate your consideration and careful review of this submittal and, as always, would be <br />happy to work with you to address any questions or concerns that azise during the review process. <br />
