(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-7n(U-m i <br />INSPECTION DATE; m-m-ro INSPECTOR~SINITIALS: r;izs <br />This inspection was conducted in response to an anonymous letter received by the Division on March 20, 2002. The letter <br />stated that a gravel pit was operating in the northeast Ya of Section 34, T 7 N, R47 W in Phillips County, that the <br />complaint filer believed that the land was owned by Sandra or John R. Kurtzer and that the gravel was being sold to <br />Ritchey's Redi-Mix in Wray Co. This location was visited and a pit was noted. No one was present at the site at the <br />time of the inspection and the only equipment observed was a loader parked at the site. After noting the pit from the <br />road the inspector observed two people working across the road. After identifying himself, the inspector learned that one <br />of the workers was the property owner's son. The inspector showed him the complaint letter and asked the son what he <br />knew about the gravel pit across the road. He replied that his father had opened the pit and that most of the material <br />was being used on the Kurtzer property, but that a concrete company had taken some of it. The inspector then asked if <br />the concrete company was Ritchey's Redi-Mix as reported in the complaint letter and he verified that it was. He also said <br />that his father was working at another property about five miles away. The inspector then drove to that property and <br />contacted John Richard (Dick) Kurtzer. Mr. Kurtzer stated that most of the gravel had been used on his property, but that <br />he had sold some of it. It should also be noted that a County employee also stated to the inspector that he had observed <br />Ritchey's trucks hauling material from the site. After talking with Mr. Kurtzer, the inspector drove back to the site and <br />made the following observations: <br />The site is located along the channel of a dry stream bed southwest of the intersection of Phillips County Roads 9 and 16 <br />The total disturbance is about 100 X 100 yards (2 acres ). It was estimated that less than one acre had been mined, <br />with a maximum mining depth of about eight feet. There was also a stockpile of material estimated at 500 to 1000 yd/3. <br />Based on the information available to the inspector, and on the observations made during this inspection, it appears that <br />this was a mining operation. A separate Reason to Believe a Violation Exists letter will be sent to the landowner and <br />Ritchey's Redi-Mix under separate cover. <br />Mr. Kurtzer has stated that he would be willing to obtain a reclamation permit if it was necessary, and would check into <br />getting the necessary paperwork put together.
