The operator Mrs. Jarldine Thornburg contacted the Division and requested a site inspection to make sure that the County who is operating the site under their permit does not affect areas more than covered by the financial warranty. The current warranty for the site according to DMG record is $14,000.00. However, the operators seem to believe the actual warranty for site to be $37,000.00 and provided a copy of a cooperate surety showing the larger amount. The site is permitted to affect q tota~ of 53 acres of the total permitted acres of 77.94 acres. At the time of the inspection approximately 4.5 acres appeared to have been affected. The operator with out exceeding the warranty, even if it is $14,000.00 until resolved, can still affect an additional 4 acres with out the need for an additional warranty. In addition since the mining is taking place at an approximate slope of 2.5: 1, the operator has an option to request a warranty reduction for the backfill and grading in the areas where mining has been completed so the warranty can be applied to areas to be affected in the future. The Division will keep an appropriate warranty to cover the cost of reclamation and can apply the rest to the areas to be affected at a later time. Permit sign was properly posted at the access to the property.
