<br />Bent County <br />August 26, 1994 <br />page 2 <br />M84-106 Davidson Ranch Pit - Please ensure that this site can be <br />accessed this fall during the next inspection trip. If release is <br />to be requested, see my comments under Etchart ~2, above. <br />M83-178 Bent County Pit - I have studied the surveyor's map you <br />sent. I agree that the irregularly shaped tract does amount to <br />only 9.81 acres, the proper size of the approved permit area. <br />However, the area described in the permit application is a <br />rectangle. At this point, we will regard the mapped tract as the <br />"reconfigured" permit area. Please be reminded that a permit area <br />must include all disturbed areas, including not just excavation, <br />but roads, stockpiles and structures. Does this mapped tract <br />include all this? Please comment on this fact, plus submit a <br />request for approval of this reconfigured permit area. I expect <br />Bent County to proceed to convert this to a 112 permit if any <br />future expansion is to occur. <br />M83-183 Clodfelter Pit - I have reviewed the statement from <br />Southeast Colorado Power Association regarding the stability of the <br />power pole and guy. Please do not disturb ground closer to the <br />pole during reclamation. Remember to review and follow the <br />specifics of the reclamation plan in the file (ie., topsoil, <br />especially), plus applicable standards in the Rules, as those will <br />be used to judge the adequacy of the reclamation efforts. <br />M83-179 Etchart Pit - Is this a pit that Bent County wishes to have <br />released? It appears that you would reclaim it but the landowner <br />does not want you to do so. (Be reminded that there exists an <br />amount of responsibility by Bent County for performing <br />reclamation.} If this is the case, please have the landowner <br />submit a statement to that effect, accompanied by a request from <br />you that the Division consider allowing Bent County to reclaim an <br />equivalent site as an alternate. <br />M83-180 Corps of Engineers Pit - Please review the Rules on <br />temporary cessation (TC), paying particular attention to the <br />maximum length of time allowable to remain in TC. If I am not <br />mistaken, this was first permitted in 1983, and you said that it <br />has been at least 12 years since the county mined there. Your <br />letter stated that the county may be able to mine in the area, due <br />to contract renewal. Is this to be additional acreage adjacent to <br />the present site? Will part of the original site be released? <br />Will this require converting to a 112 permit? Please clarify these <br />points. one final comment: you state that "we will need to <br />transfer that permit to another site if possible." This is not <br />possible. <br />
