III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. "l he comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. Bill Bear represented the <br />operator. The mine site has received a lot of rain in the last two weeks. <br />(~droloev <br />Because of the recent rains, Bowie has discharged from its ponds. As a result, the water levels in the ponds were <br />very low. The water in Pond B was below the primary discharge tube level. Pond B had the float attached to the <br />primary discharge tube. The gated valve was closed. The operator has recently placed a pipe in the Deer Trail <br />Ditch so that any water in [hat ditch will be in the pipe and won't teak into the adjacent Fire Mountain Canal. <br />The Pond B discharge enters this pipe as well.'fhe pipe will be extended further out. <br />Pond C also had the primary float in place. The water level in the pond was neaz the level of the primary <br />discharge tube. According to the operator, no flocculent was needed in the recent Yond C discharge. "There was <br />only a little standing water in Pond D, about one foot below the primary discharge tube. The gated valve was <br />closed. There is no float on Pond D. <br />Pond F, at the base of gob pile no. 2, had about two feet of water in it. The float was attached to the primary and <br />the pond discharge pump was in place. The emergency spillway over the Fire Mountain Canal was operational. <br />At the unit train loadout, there was no water in Pond J. However, Pond K had a tittle standing water. Both pond <br />embankments were stable and dischazge structures were functional. <br />Gob Piles <br />The operator has been utilizing the newly permitted borrow area between gob pile no. 1 and gob pile no. 2 to <br />cover the first 50 foot lib of gob pile no. 2 with soil material. "Topsoil is also being applied, with seeding to <br />follow later. <br />Koads <br />The main paved haul road was in very good condition. The guard rail was in place. The gob pile azea haul road <br />was muddy but was passable. The road ditches had sufficient capacity and the outside berm was functional. <br />Facilities <br />There was a fairly large volume of stockpiled coal on the lower coal stockpile bench and on the D-seam portal <br />bench. There were no indications, however, of any fugitive dust problems offsite. The operations on the D-seam <br />ports! bench and the B-seam portal bench were order) y and clean. There were no leaks at the fuel barn. The <br />highwalls were stable. No problems were noted at the pump house either. A loaded coal train was on site but no <br />problems with fugitive dust were observed. The operator was filling the antifreeze tank at the loadout bin. <br />
