III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the Arness McGriffen Mine was conducted by DMG staff from the <br />Durango Office, 701 Camino del Rio, Room 125, Durango, CO 81301, phone (970) 247- <br />5469. The permit for the Arness McGriffen Mine was revoked over 5 years ago. Financial <br />warranty was forfeited and utilized for final reclamation. No activities were observed, no <br />personnel encountered during the time of this inspection. <br />No changes were observed since the last inspection. <br />The cable gate across the mine access road was open. Public access to the site and <br />adjacent state lands is controlled by locked cable closure. Reclamation efforts may benefit <br />from the controlled access. <br />Portions of the reclaimed area have been adversely impacted by off-road traffic and illegal <br />dumping. <br />Access road exhibited evidence of erosion in the roadside drainage ditch and to the driving <br />surface. Guardrail, constructed of timbers and cable was intact. Soil conditions were dry. <br />
