(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1997-n6a <br />INSPECTION DATE: 5-~o-n~ INSPECTORS INITIALS: __JR__ <br />OBSERVATIONS <br />Completed a partial inspection of this site to determine whether the existing financial warranty is adequate and to <br />determine whether the operator has right of access to the site. <br />The site is located about '/s mile west of Highway 115 nearly 21 miles south of Colorado Springs. <br />A mine I b sign has been placed at the entrance to the permit area just a short distance off of the highway. The 9.9 acre <br />permit is adequately delineated with short 4X4 wood posts. <br />Mining is progressing from southeast to northwest. Currently, approximately 5 acres have been disturbed. The existing $20, <br />600 financial warranty is more than adequate to reclaim current disturbances pursuant to the approved reclamation plan. <br />Currently, it is questionable whether the operator has right of access to the site to initiate a mining operation on the <br />affected land. It is possible, the quarry mining lease (number QR 3280) from the State Board of Land Commissioners has <br />expired, or was not renewed. If this is the case, the operator could be in violation of the Act/Construction Materials Rules <br />and Regulations. This is noted as a problem on page three of this report which will need to be addressed by the corrective <br />action due date. The operator shall be given 60 days to submit documentation to the DMG that right of access is still valid <br />or submit notice to the DMG that the operator no longer has right of access to the permit area.
