<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />General Comments <br />This was an aerial inspection of the McClane Canyon Mine. The site was flown the afternoon of 8/28/07, and 6 <br />oblique and near vertical digital image photos were taken by Harry Ranney of the Division. The images (0195 <br />through 0200) were viewed by Dan Mathews of the Division on 8/30/07. <br />Site conditions appear not to have changed appreciably since the previous site inspection. McClane Creek and <br />East Salt Creek both appeared to be dry. The sediment pond contained a pool of water, but elevation of the pool <br />relative to the primary spillway could not be discerned. Details of ditch and culvert maintenance activity could not <br />be determined from the photos. It appeared that sediment was properly being contained within disturbed areas <br />and no obvious problems were apparent. Proper dust suppression efforts were evident, based on the absence <br />of dust generation along the haul road and in the coal stockpile area. <br />3 <br />
