III. COMMENTS • COMPLIANCE <br />Below are comments on the inspection The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial mspectlon conducted by Kent Gorham of the Colorado Division of Minerals <br />and Geology (Division). This former mountaintop removal operation is now reclaimed and <br />has achieved a Phase I bond release for most areas. Ground conditions on this day were <br />generally dry and the weather was unseasonably mild. Patchy snow cover was present only <br />in shaded areas. <br />Roads <br />The second culvert ascending the Jeff Canyon haul road remains partially blocked with <br />sediment due to summer storm runoff. This culvert should be cleared as soon as equipment <br />is returned to the site. <br />Hydrologic E3a <br />A contractor hired by Pioneer Resources was just finishing replacing a culvert under a gas <br />line. This culvert is located between the toe of Fill 8 and pond 8. Erosion below the culvert <br />has been repaired using rock and fill material. The contractor also repaired the road, road <br />ditch, and the cut slope above the road. A berm established on the east slope should assist <br />in directing runoff to the culvert inlet area rather than eroding the fill above the culvert outlet. <br />Overall, the site appeared in good condition for the winter season. <br />Pond 6, pond 8, and pond 9 held moderate amounts of frozen water. The pond <br />embankments and spillways at each of these ponds appeared in excellent condition. <br />
