III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Gillis of the Colorado Division of Minerals and Geology. Ross <br />Gubka represented the operator. Skies were clear and the ground was dry at the time of the inspection. With the <br />operator's consent, this report was issued from the Durango office. <br />HYDROLOGIC BALANCE: <br />Sediment ponds and collection ditches were functioning properly at the time of the inspection. Water from pit <br />dewatering operations is being routed into the lazge 1-cell pond situated to the south & west of the active pit area. <br />The operator had some questions regazding pond design and minimum required retention time for situations <br />where a sediment pond is being used to hold water from pit dewatering activities as well as runoff from the 10 <br />year, 24 hour storm event. This issue will be referred to one of the Division's surface water hydrologists for <br />further consideration. <br />
