III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />This parfial inspection of the King Coal Mine was conducted by DMG staff from the Durango <br />Office, 701 Camino del Rio, Room 125, Durango, CO 81301, phone (970) 247-5469. <br />Mine identification sign was posted at the mine entrance. Permit boundary markers were <br />posted. Entrance gate was open. Mine entrance road was well maintained. Drainage <br />conveyance swale, directing yard and road drainage to the small sediment pond, was intact and <br />functioning as designed. <br />Upland diversion ditch for the Refuse Disposal Pile appeared stable, evidence of excessive <br />erosion and/or sedimentation was not observed. Steep slope sections of the upland diversion <br />ditch had a trapezoidal cross section and was entirely rock lined with large rock overlying a <br />fabric liner. Debris screens appeared intact and clean. Upland diversion ditch for the portal <br />side of the yard appeared well maintained and stable, debris screens were intact and clean. <br />Surface of Refuse Disposal Pile was graded to ensure positive drainage and to direct affected <br />area drainage to designed sediment containment ditches and culverts. <br />Large sediment pond was holding water, water depth was approximately 2'. Primary and <br />secondary spillways appeared intact, clear of debris and capable .of functioning as designed, <br />no discharge noted. Pond embankment appeared stable. Overflow pipe to the small pond was <br />intact, no flow noted. <br />Small sediment pond was dry. Primary and secondary spillways appeared intact, clear of debris <br />and capable of functioning as designed, no discharge noted. Embankment appeared stable. <br />
