III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection of the Marr Strip Mine and Walden loadout facility conducted on <br />August 11, 2003 by Mike Boulay of the DMG. There were no representatives from Kerr Coal <br />Company present during the inspection. There was no activity at the site. Weather conditions <br />were cloudy and hot. It began raining towazds the end of the inspection. The ground conditions <br />were very dry prior to the brief rainstorm. <br />Availability of Records <br />Records were reviewed at the Montgomery Watson Harza office in Steamboat Springs on the <br />morning of August 13, 2003. Please see the attached Availability of Records checklist. <br />Hydroloeic Balance <br />All site sedimentation ponds were inspected. None of the site ponds were dischazging at the time <br />of the inspection. Pond A was retaining water at a level approximately one foot below the weep <br />hole in the primary spillway. The Pond A dischazge pipe appeazs to be seeping a small amount <br />of water. Although the water level was below the lower weep hole in the primary spillway, a <br />very small amount of water was dischazging from the outlet. Ponds B, D, and E were retaining a <br />significant amount of water, but at a level well below the primary spillway. Pond C was holding <br />a very small amount of water. Ponds F and G were completely dry. Road surfaces and road <br />ditches were dry and generally well maintained. <br />Reve etg ation <br />Vegetation (primarily grasses) appeared to be browning up due to the lack of moisture at the site. <br />Thistle was noted at several locations including: around the south west side of Pond B, in and <br />aoound the Pond D inlet, and the Pond E embankment. Please continue to control the growth of <br />troublesome weeds throughout the mine site. <br />Loadout <br />The entrance gate to the loadout was unlocked and open at the time of the inspection. Ground <br />conditions were very dry at the loadout. The loadout pond was retaining some water, but well <br />below the level of the spillway. The loadout azea was generally well maintained and no problems <br />were noted at the site. <br />
