III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made during the
inspection. Comments also describe any enforcement actions taken during the inspection and the facts or
evidence supporting the enforcement action.
This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. No one represented the operator
during the inspection.
Signs and Markers
The mine ID sign was on its post but the post needs to be set back up off of the ground. Surface disturbance
markers were up around the disturbed area.
Roads
The paved entrance road was in good condition. The gate at the entrance to the mine site was closed and locked.
The "no trespassing" sign was on the gate.
Hydrology
The sediment pond was dry. The gate on the primary dischazge tube was closed. The riprapped emergency
spillway was functional. The collection ditch leading into this pond was well vegetated.
The east spring was flowing into the collection ditch, although a small trickle of water has jumped the ditch and
is collecting neaz the mine office. The spring water treatment pond was discharging at about 20 gpm. The
discharge water was orange in color. In spite of the orange color, this water has been shown to be in compliance
with water quality standards.
The facilities area protection berm along the river was functional. No problems were noted with the two alluvial
wells. The caps on both wells were on.
Facilities
The doors to the mine office building were open. No changes were observed with the rundown building.
Reclamation
Most of the backfilled and graded portal road and portals had a good vegetative cover and appeared to be stable.
The west side backfilled portal area had sparse vegetative cover. The slide area just west of the mine disturbance
area is continuing to slowly slide downward. There is a lot of cheat grass on the flat facilities area. The
vegetative stand is rather short in height, less that one foot tall.
Noxious Weeds
A patch of thistle east of the mine office had been sprayed. The operator has cut down tamarisk that was
growing in the seep area west of and adjacent to the east side spring. However, more tamarisk and thistle are in
this area and next to the spring. Tamarisk has also reappeared at the water's edge of the spring water treatment
pond. Tamarisk is also located along the west side fence, at the mine site entrance. These noxious weeds need to
be dealt with.
c:/word/beaz3/insp0806
