Long <br />San Luis, CO 81152 Din lion DirMOr <br />RE: Costilla Landfill Pit (Permit M-80-233) Apparent failure to <br />comply with conditions of permit, ie. ground water monitoring <br />requirements <br />Dear Mr. Espinosa: <br />The Division has received the results of the 4th quarter sampling <br />of ground water from the series of monitoring wells at the Landfill <br />Pit. This sampling was conducted on December 4, 1996. It was <br />reported, however, that at that time ground water samples were only <br />recovered from wells MW1 and MW4. Wells MW2 and MW3 were reported <br />as dry. The same condition was reported for the 3rd quarter <br />sampling conducted on September 5, 1996. <br />As a result on this, while the 4 quarters of ground water <br />monitoring at the Landfill Pit have provided 4 samples from wells <br />MW1 and MN4, only two samples have been secured from wells MW2 and <br />MW3. Monitoring wells MW1 and MW4 are, according to the early <br />representation made of the local potentiometric surface, up <br />gradient from the Landfill Pit and in a position to supply samples <br />of ground water presumably unaffected by the pit. Wells MW2 and <br />MW3, however, are downgradient and in a position to yield ground <br />water that might be contaminated by the pit. Consequently, the <br />determination of ground water quality in wells MW2 and MW3 is of <br />the upmost concern to the Division. If these wells are frequently <br />dry and unable to consistently furnish ground water quality <br />samples, they are neither acceptable to the Division for normal <br />monitoring purposes or to serve as Point(s) of Compliance at the <br />conclusion of and subsequent to the first 5 quarters of required <br />ground water sampling (See Conditions to Approval of Technical <br />Revision 1-Ground Water Monitoring Plan). <br />As a result of this situation, the Division considers that a <br />Compliance Problem exists at the Landfill Pit. This problem is a <br />failure to comply with a condition of the permit, ie. Condition 8 <br />to the approval of Technical Revision 1-Ground Water Monitoring <br />Plan which requires that ground water samples be obtained from the <br />approved ground water monitoring wells at least one time each <br />
