A site inspection was made of the Mid-Western Farms 112 Sand 6 Gravel Operation. <br />2. Concerns as listed in the Division's 11/3/96 inspection report have been addressed by the <br />operator. Topsoil stockpiles have been stabilized by regrading to a 3:1 elope and covering <br />with a 4-6 inch layer of manure. Topsoil stockpiles will be seeded with a temporary cover <br />crop in late March. An entrance sign was also posted, as ~requeeted. Only one concern <br />remains; submittal of a survey of the current disturbance to verify compliance with the mine <br />plan. Mr. Miller indicated that a recent survey revealed a total disturbance of <br />approximately 110 acres, with 40 acres disturbed at the plant Bite and 70 acres disturbed <br />south of the railroad tracks. The mining plan, however, specifies a maximum allowable <br />disturbance of 108.2 acres. All disturbances have occurred within the 1470 acre permitted <br />area. Therefore, in order to verify compliance with the mine plan, the Division requests <br />that the operator submit within 30 days a copy of the recent survey. Please see page 3 for <br />details. <br />3. The operator has posted a financial warranty of $467,254 in the form of a deed of trust. <br />The Division would like to advise the operator that the Mine Land Reclamation Board ie <br />currently reviewing the adequacy of existing deeds of trust and evaluating whether they will <br />continue to accept deeds of trust ae a bonding instrument. Further, an operator must supply <br />an acceptable substitute financial warranty prior to the sale of land listed in a deed of <br />trust bonding instrument. <br />4. Mr. Miller who has been with Mid-Western Farms since November, 1995 inquired ae to Mid- <br />Western Farms's responsibility for reclamation of the Bite. I informed him of the basic <br />components of the plan and suggested that he consider amending the existing plan to a more <br />feasible land use, based on the current site conditions.
