<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado Division of Minerals and <br />Geology. Basil Bear represented the operator in the office. <br />Hydroloey <br />Ponds 1, 2, 3 and 4 at the main mine were dry. The ponds at the train loadout, ROM pile and the <br />west ridge waste pile also were dry.. There was only a little water in the highway coal stockpile <br />pond. The water level in the pond at the west mine was several feet below dischazge. The <br />spillways for all of the ponds were functional. Pond embankments were stable, as were the pond <br />inslopes. <br />Gob Piles <br />There have not been any recent additions to the west ridge waste pile. No geotechnical slope <br />instability or erosional instability were observed at the west ridge waste pile and the old waste <br />pile. There was a good stand of vegetation at both gob piles. <br />Facilities <br />There were no problems with any of the facilities. The operator is using the crushing/screening <br />bench to temporarily store material for later shipment out. At the train loadout, the Union Pacific <br />is replacing some of the tracks along the spur just east of the loadout. There were no leaks of fue; <br />at the train loadout fueling facilities. <br />Reclamation <br />The operator is preparing to reclaim the west mine. Structures are being moved out.
