<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the New Horizon Mine was conducted by Wally Erickson from <br />the DMG Durango Office, 484 Turner Drive, Building F, Suite 101, Durango, CO <br />81301, phone (970) 247-5469. Operations were active during the time of this <br />inspection. John King accompanied the DMG inspector throughout the inspection. <br />Signs & Markers -Mine identification sign and safety signs were posted at the mine <br />entrance. Permit boundary markers were observed. Public access is controlled by gate <br />and fence, gate was open. <br />Roads -Mine haul roads and access roads were well maintained. <br />Hydrologic Balance -Affected area drainage from the active pit and reclamation areas <br />were contained within the pit or conveyed to pond 007 for treatment. <br />Sediment trap 003, Small Area Exemption, was dry. Straw bale filters were intact <br />within the sediment containment ditch. Evidence of embankment instability was not <br />observed. <br />Sediment pond 004 was dry, no discharge noted. Primary and secondary spillways <br />were intact and clear of debris. Embankment was well vegetated and stable. Minor <br />occurrence of knapweed was observed on the pond embankment. Knapweed has <br />apparently invaded pond 004 embankment from the adjacent county road side area. <br />Backfill & Grading -Evidence of slumping, settling or excessive erosion was not <br />observed, reclaimed areas appeared stable. Reclamation backfilling and grading of the <br />active pit area appeared current. <br />
