III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
This was a partial inspection conducted by Tom Kaldenbach and David Berry of the Colorado Division
of Minerals and Geology. No one else was present. The ground was wet and covered with patches of
melting snow.
SIGNS AND MARKERS
Topsoil markers are in place on all 3 topsoil stockpiles
HYDROLOGIC BALANCE
Sedimentation Ponds
The truck loop pond (Pond 1) pond was partially covered with melting ice. The water level was barely
reaching the bottom of the spillway culvert. The pond's inslopes and embankment appeared stable.
The rail loop pond was also partially covered with melting ice. The water level was less than one foot
below the top of the trapezoidal spillway. Sediment on the spillway indicated the pond may have
discharged recently.
Ditches
The westernmost 75 feet of Ditch 9 still needs sediment cleaned out of it so that it meets design
specifications, although it currently remains capable of functioning. The operator is reminded that any
offsite discharge from the ditch will result in enforcement action.
Culvert LFC 1 is functioning but needs sediment cleaned out. The intersection of the following four
culverts needs to be mucked out to maintain positive drainage: LFC 3, LFC 4, and LFC 5.
-3-
