III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach and David Berry of the Colorado Division <br />of Minerals and Geology. No one else was present. The ground was wet and covered with patches of <br />melting snow. <br />SIGNS AND MARKERS <br />Topsoil markers are in place on all 3 topsoil stockpiles <br />HYDROLOGIC BALANCE <br />Sedimentation Ponds <br />The truck loop pond (Pond 1) pond was partially covered with melting ice. The water level was barely <br />reaching the bottom of the spillway culvert. The pond's inslopes and embankment appeared stable. <br />The rail loop pond was also partially covered with melting ice. The water level was less than one foot <br />below the top of the trapezoidal spillway. Sediment on the spillway indicated the pond may have <br />discharged recently. <br />Ditches <br />The westernmost 75 feet of Ditch 9 still needs sediment cleaned out of it so that it meets design <br />specifications, although it currently remains capable of functioning. The operator is reminded that any <br />offsite discharge from the ditch will result in enforcement action. <br />Culvert LFC 1 is functioning but needs sediment cleaned out. The intersection of the following four <br />culverts needs to be mucked out to maintain positive drainage: LFC 3, LFC 4, and LFC 5. <br />-3- <br />
