(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1977-559 <br />INSPECTION DATE 1/16/07 <br />OBSERVATIONS <br />INSPECTOR'S INITIALS RCO <br />This inspection was performed by the Division as part of its monitoring of Construction Materials 112c permits. The operator <br />was contacted about the scheduled inspection, but was not present during the inspection. The site was active at the time of the <br />inspection. <br />The site consists of two separate areas across McKenzie Avenue from each other. The triangular area east of the road <br />contains an excavated pond and concrete processing area; a newer excavation area is west of the road. Excavation is <br />apparently completed in the east pond, and most of the pond banks exhibit varying degrees of reclamation. The approved <br />reclamation plan for this east area requires the clean-up of the area's debris, removal of all structures of the processing plant, <br />and the grading, topsoil replacement, and revegetation of the areas above the pond margins. Some roadways are approved to <br />remain. <br />The processing/hatching plant is within the permitted area boundary. Stormwater runoff is all directed to the pond. The <br />operations at the plant occur on a surface only several feet in elevation above the pond's water level. There are numerous <br />tanks, drums, buckets and other various vessels on the site, many containing a variety of fluids including hydrocarbons. Due to <br />the potential for contamination of surface and groundwater, it is important to properly store all contaminants properly. There <br />observed improper storage of the fluids and fuel, the topic of "acid or toxic materials" is noted as a problem on page one. The <br />correction of this problem requires the operator to cease storage of these materials onsite until impermeable secondary <br />containment of adequate capacity is made available. See the last page for the correction date. <br />South of the permitted pond and north of the Arkansas River, there is an area of several acres containing a significant amount <br />The western portion of the permit was added in 1987 as part of Amendment 1, and is called Stage 5. That pit was active during <br />the inspection. There was a dewatering pump maintaining the pit floor dry, and sending water under McKenzie Avenue to the <br />eastern pond. The pit is mined down below the water table to the underlying shale layer, and will be reclaimed as a pond. <br />Topsoil has been salvaged and is stockpiled along the western boundary. A crusher was being fed by two loaders, removing <br />the last of the pit's available material, in the northern end of the pit. Some of the pit slopes are graded. The operator should <br />ensure, for both of the ponds/pits, that slope grading or backfilling results in gradients that meet the 3:1 standard in the <br />reclamation plan, prior to replacing the topsoil or revegetating. <br />The bond has not been recalculated in several years, and this office is again required to do so. The operator will be provided <br />with any updated bond amount figures. If an increase is indicated the operator will have 60 days in which to provide the <br />additional bond. The operator is reminded that resolution of the questions concerning the debris area in or near the south end <br />of the site involve problem correction and may also influence the bond amount. <br />No further items were observed during the inspection. The correction of this problem requires the operator to <br />provide this office with a short description and photos of where the southern limit of the permit lies, in relation to the debris area <br />described above.
