III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology. The Rimrock Mine consists of approximately seven acres of <br />reclamation. The weather was cool and seasonable. <br />Availability of Records <br />The public copy of the mine records is kept at the Office of the Las Animas County Planner <br />at the Las Animas County courthouse. The insurance certificate had expired as of July 1, <br />2002. Quarterly reports for the second and third quarters for the sediment pond and <br />discharge self-monitoring reports were also not located. The operator was contacted by <br />phone and indicated that those documents had been mailed to the courthouse the week of <br />December 9. Please ensure all records are current at all times through the previous <br />calendar quarter. <br />Hydrologic Balance <br />The single sediment pond at the site was dry. Snow was present in shaded areas in the <br />bottom of the pond. The trickle tube was clear of any debris and the emergency spillway <br />appeared normal. <br />Reveoetation <br />Patchy snow covered the reclaimed slope. The growing season is over. Grazing since last <br />inspection was not evident and cattle were not seen on the site or in the surrounding <br />pastures. <br />Overall, the site appeared in normal condition for the winter season. <br />
