<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This aerial inspection was flown on April 13, 2001. The digital images were available on April <br />16, 2001. Due to vacation and workload, the digital images were not reviewed until May 11, <br />2001. There were no compliance problems observed during the overflight. <br />Hydroloey <br />The water level in Pond C was above the level of the primary discharge tube but several feet <br />below the emergency spillway. The water in the pond appeazed to be blackish. There was only a <br />modest cover of vegetation on the pond embankment. There was a little amount of water in Pond <br />D. There was a small amount of water in Pond B, some of which appears to be from washing <br />down the highway. Pond inslopes and outslopes appeared to be stable. <br />Roads <br />The entrance road to the mine site is taking on a black stain color. However, the coal appears to <br />be contained in the sediment control system. The paved haul road appears to be in good <br />condition. The haul road leading to the gob pile appeared to be wet, but in good shape. <br />To soil <br />There was no erosional gullying at the main topsoil stockpile and the gob pile topsoil stockpile. <br />Diversion ditches and silt fence were in place. <br />Gob Pile <br />There was no activity or equipment at the gob pile. There was no evidence of ponding on top of <br />the pile. The outslope of the gob pile has little or no vegetation. <br />Facilities <br />The haul trucks were loading at the loading bin, rather than with front end loaders. This has cut <br />down on the fugitive dust considerably. There is a large amount of coal that has been stockpiled <br />at the lower bench, but not as much as has been stockpiled before. There is coal along Old <br />Highway 133, presumably from the haul trucks and, perhaps from the coal stockpile. However, it <br />appears that the coal fines are being contained within the sediment control system. <br />c: \ms97\bowie2\insp0401 <br />
