III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />On March 30th the Division conducted a complete inspection at the Bourg Strip <br />Mine. This inspection was also an OSM oversight inspection with Gary Fritz <br />representing the OSM. At the time of the inspection the weather was clear and <br />warm. Spring snowmelt was in full swing. <br />The records were checked at the Jackson County courthouse. The records <br />were up to date with the exception of the 1993 annual reclamation and <br />hydrologic reports. This report was sent to the Division office, was reviewed <br />and determined to be adequate. This mine has had all ponds removed, thus <br />does not have an NPDES outfall but at this inspection there was some question <br />whether this mine falls under the stormwater regulations. A letter addressing <br />this issue will be sent to the operator. <br />The loadout was inspected at Northgate. Most of the snow has melted off. The <br />area was weti vegetated. No concerns were noted. <br />The mine site was inspected and the reclaim area walked. The surtace of the <br />ground was wet and soft from snowmelt and freeze /thaw. The permanent <br />gully was still full of snow and water was not flowing down this drainage. <br />On the southeast portion of the permit area a water fined depression was noted <br />with a size of 100 by 300 feet. Mature sage was noted around the this area. <br />The depth of the water was from several inches to no more than 1 foot. A <br />review of the maps of this undisturbed area do not show this depression; there <br />is a Large circular basin area but no closed contours. it is possible that the <br />depression is so shallow that it would not show with 5 foot contour intervals. <br />The area has mature sage and this appears to be a natural depression. The <br />frozen ground underneath is probably impermeable aiding the ponding of the <br />water. <br />The reclaim was walked; the eastern reclaim had better success with sage. <br />Small repaired gullies were noted on the north east portion of the reclaim. The <br />erosion did not appear to be active. Mann draw was wet but no flow was <br />noted. <br />An area of standing water was noted on the eastern central area from the <br />recent snowmelt. The area was 50 by 150 feet and about 4 to 6 inches deep. <br />
