<br /> <br />111 COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the New Horizon Mine was conducted by DMG staff from the DMG <br />Durango Office, 484 Turner Drive, Building F, Suite 101, Durango, CO 81301, phone (970) 247- <br />5469. Operations were active during the time of this inspection. Ross Gubka was present <br />during the inspection. <br />ACTIVE PIT AREA was observed from County Road BB. Reclamation backfiil, grading and topsoil <br />replacement appeared current. Side roll irrigation equipment was intact and watering recently <br />seeded and topsoiled areas. Recently reclaimed areas appeared stable, no evidence of slumping, <br />settling or excessive erosion was observed. Affected area drainage appeared to be controlled in <br />accordance with permit conditions. <br />RECLAIMED AREAS NORTHWEST OF THE ACTIVE PIT AREA <br />SAE 003 Sediment containment sump was dry, well vegetated and stable. Vegetative cover <br />for reclaimed areas was well established and appeared sufficient to control erosion. Operator has <br />controlled erosion and sedimentation in the sediment containment ditch by installing energy <br />dissipating straw bales. Evidence of minor erosion within the sediment containment ditch <br />appeared to have occurred prior to installation of the straw bales. <br />Pond 004 Pond 004 was dry. Reclaimed areas within the watershed for Pond 004 were well <br />vegetated and stable, no evidence of slumping or excessive erosion. Pond inslopes and <br />embankment were well vegetated and stable. Primary spillway was clear of debris, no discharge <br />noted, brush guard and anti-vortex fin were intact on the CMP inlet riser. Secondary spillway <br />appeared stable, no evidence of discharge. Russian knapweed was established along the county <br />road and has infiltrated across the permit boundary onto the pond embankment. The noxious <br />weed was not well established within the permit area but will become a serious pest and possible <br />obstruction to successful revegetation if not eradicated prior to establishment. <br />Pond 005 Pond 005 was dry. Reclaimed areas within the watershed for Pond 005 were well <br />vegetated and stable, no evidence of slumping or excessive erosion. Pond inslopes and <br />embankment were well vegetated and stable. Primary spillway was clear of debris, no discharge <br />noted, brush guard and anti-vortex fin were intact on the CMP inlet riser. Russian knapweed was <br />present on the pond embankment, see comments under Pond 004. <br />Pond 006 Pond 006 was holding water, two Canada geese and a Mallard hen and drake were <br />present. Pond inslopes and embankment were well vegetated and stable. Primary spillway was <br />clear of debris, discharge was visually estimated at <1 gpm, brush guard and anti-vortex fin <br />were intact on CMP inlet riser. <br />
