(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1977-443 <br />INSPECTION DATE 4-21-OS INSPECTOR'S INITIALS GRS <br />This was a general monitoring inspection of the Moon Pit No. 2 conducted by Gregg Squire of <br />the Division of Minerals and Geology. Pat Weber, the permit holder, was also present during <br />the inspection. Weather conditions on site were cloudy and the ground was dry. The site is <br />located about 17 miles west of Craig on US Highway 40 and then )4 mile north on C.R. 5. <br />Site conditions appeared to be very similar to those reported during the December 16, 1999 <br />inspection. The approximately five acres of permitted area is nearly all disturbed. <br />Disturbances include pit high walls, overburden and topsoil stockpiles, and product <br />stockpiles. Reclamation to be done includes: <br />1) Approximately 1900 linear feet of highwall, averaging 14 feet in height, to be reduced <br />from 1;1 slopes to 3:1 slopes. <br />2) Finish grading of approximately one acre/ft of pit floor. <br />3) Backfill and grade approximately 5,000 cu./yds. Of overburden stockpiled around the <br />perimeter of the pit. <br />4) Spread approximately 4,000 cu./yds. Of topsoil stockpiled around the perimeter of the <br />pit. <br />5) Seed the five acre pit area. <br />The Division has calculated a cost of $12,500.00 to complete these tasks. A copy of the cost <br />estimate is attached. <br />Since the estimated reclamation liability at the site is $12,500.00, the existing financial <br />warranty of $2,500.00 is not adequate. The Division considers this to be a problem which <br />must be corrected. The Colorado Land Reclamation Act for the Extraction of Construction <br />Materials (the Act), Section 34-32.5 (4)(c)(I)(A)states that "The board may: From time to time <br />and for good cause shown, increase or decrease the amount and duration of a required <br />financial warranty;" The Division requests that the operator submit a replacement warranty in <br />the amount of $12,500.00 or a supplemental warranty in the amount of $10,000.00 within 60 <br />days of the receipt of this notice. As an alternative, the operator may perform reclamation <br />measures to reduce the current liability to an amount equal to or less than $2,500.00. This <br />work would require that all overburden regrading, highwall reduction, finish grading and <br />topsoiling be done, since the cost of revegetation and mob/demob alone is nearly as much as <br />the current $2,500.00 bond. If this alternative is chosen, the operator must provide the <br />Division of photographs and a written description of the work which has been done within the <br />60 day time frame, after the receipt of this report.
