III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Carbon Junction Mine for the month of July, 2001. The weather <br />is clear and warm. <br />Availability of Records: The records inspected and some critical reports were missing and pond <br />inspections were not performed by professional engineers or personnel competent in the design or <br />construction of sediment ponds. This latter matter has finally been resolved, however, the final fill <br />certification of stability has not been received at this office, nor was it located <br />at the mine. Please note, that if the Division has not received this document, <br />which must have been performed by professional engineers qualified in <br />stability analysis, by August 31, 2001, an NOV will be written. see page 5 of this <br />report for further details. <br />Signs and Markers: The Mine ID sign is still out of date and requires the correct address ,phone <br />number and point of contact listed. <br />Hydrologic Balance: All ditches, culverts and ponds were inspected. Both ponds were inspected and <br />appeared stable and were not discharging. All culverts were clear and capable of functioning as <br />designed. <br />Excess Saoil and Development Waste :The area of the Waste pile fhaf Was fop5olled IS <br />infested with weeds and requires spraying as well as numerous other spots <br />in the coal permit boundary. <br />General Mine Compliance: The site needs a sustained weed control program. A letter received on <br />July 27, 2001 indicate that Four Corners Gravel will perform final reclamation on the disturbed acreage <br />later this fall. <br />
