III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made during the
inspection. Comments also describe any enforcement actions taken during the inspection and the facts or
evidence supporting the enforcement action.
This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. No one represented the operator
during the inspection. There was no activity on site. The river was running rather high.
Roads
The paved haul road was in good condition and was passable. The bridge was also passable
Signs and Markers
The mine ID sign was at the top of the hill but the sign post was on the ground and needs to be put back up. The
"no trespassing" sign was up on the front gate at the mine site entrance. Surface disturbance markers were up
around the mine site.
Hydrology
The sediment control system was in place and operational. The water level in the sediment pond was about 6
inches below the level of the primary discharge pipe. The gated valve on the pipe was closed. The emergency
spillway was functional The collection ditch that leads into the sediment pond was well vegetated and had
sufficient capacity. The berm that protects the mine site from the river was functional as well.
The spring water treatment pond water level was about 8 inches below the elevation of the horizontal pipe. The
discharge into the river was about 15 gpm and was the usual orange color, which has been found to be in
compliance.
The spring coming out of the hillside was flowing properly into its channel. The spring water temperature was
about 97 °F at a location about 10 feet down stream of where the spring comes out of the hillside.
No problems were noted with the two alluvial wells. Both well caps were on
Vegetation
The vegetation on the flat facilities area and on the hillside was good. The operator was recently spraying for
weeds. More spraying needs to be done on the east side of the site. Tamarisk was also found near the front gate
and around the hillside spring.
Facilities
There has been no change with the mine office. The front gate was closed and locked.
c:/word/bear3/insp0507
