(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1995-097 <br />INSPECTION DATE 10-29-2002 <br />INSPECTOR'S INITIALS SSS <br />This was a brief partial inspection conducted to follow-up on problems listed in the previous inspection report and verify if <br />corrective actions had been taken for those problems. <br />Noxious and/or problematic weed infestation was observed within the affected area during the previous inspection. To date a <br />weed control plan, drafted with input from, and approved by, the local weed control authority, has not been submitted to dmg as <br />required. It is currently too early in the season to evaluate if any weed control was conducted last fall in response to the <br />previous inspection. <br />As noted in the previous inspection report, the approved mine plan contains commitments to regrade the main bench so that it <br />drains toward the large depression near the entrance; regrade the top of the No. 2 portal dump to drain into the mountain; fence <br />the site and perform some reseeding within 3 years of permit issuance in January 1997. DMG records have no documentation <br />that these commitments have been accomplished. This inspection is an attempt to verify that this regrading has been <br />completed, due to an apparent lack of documentation verifying this regrading occurred. The lower bench does, for the most <br />part, drain to the large depression near the entrance. Some drainage that falls on the access road may run out the entrance, <br />but this would bean insignificant amount and would not come into contact with any appreciable mine waste material. It is hard <br />to tell if the top of the No. 2 portal dump drains toward the portal and into the mountain as is required. This may need to be <br />inspected during a rainstorm, or demonstrated with a few buckets of water. As for the revegetation, a major portion of the main <br />bench was revegetated where fill was brought into the site and disposed of under agreement with other government agencies. <br />The operator will need to clarify if this importation and permanent disposal of material was conducted prior to issuance of the <br />DMG permit. If not, a revision to the permit may need to be filed, incorporating all details of this material disposal, to ensure <br />this operation meets the requirements of the Mined Land Reclamation Act.. <br />There are still several barrels, 5 gallon cans, and fuel tanks on the main bench area that contain hazardous materials such as <br />waste oil. gasoline, hytlraulic fluid, diesel fuel, antifreeze, etc. that are not stored properly within approved spill containment <br />structures. These containers were identified during the previous inspection and noted as a problem. However, these <br />containers of hazardous materials, have not been stored within approved spill containment structures or been removed from <br />site and properly disposed of, as was required to correct the problem. If all hazardous materials are not properly stored on site <br />or removed from site by May 30, 2003, DMG may pursue enforcement action. If these materials are to be stored on site, <br />details and specifications for spill containment facilities and a statement of what materials, in what quantities, will be stored <br />within the spill containment, must be incorporated into the permit through the technical revision process. The technical revision <br />will need to include wording that is specified in the memo enclosed in the previous inspection report, regarding DMG notification <br />requirements for spills of toxic or hazardous materials at mine sites.
