(Page 2) <br />iv11NE ID # OR PROSPECTING ID #: M-1980-131 <br />INSPECTION DATE: 6-20-07 <br />INSPECTOR'S INITIALS GRM <br />This inspection was conducted as part of the normal program established by the Colorado Division ofReclamation, <br />Mining and Safety for permitted sites were citizen complaints and inquires are received. The Division received a <br />written complaint about possible off site damage from a Mrs. Dewsnup on December I 1 ~', 2006. Due to heavy snow <br />cover and winter conditions an on site inspection was not achievable. The Division issued a Weather Letter on <br />January 3`d, 2007. Conditioned did not improve until April and Division scheduling did not allow for an inspection <br />until mid June. Inspectors Russ Means and Tom Schreiner met with Steve Baker of 3 B's, personnel from the <br />nearby Bunn Ranch Pit and Mrs. Dewsnup. <br />Of specific concern to Mrs. Dewsnup is the creation of an erosional feature along the west side ofher property which <br />is adjacent to the Deakins Pit. The property is the site of the old Craig Drive-in movie theater which sits on an upper <br />terrace above the area of concern. Mrs. Dewsnup contends in her letter that the Deakins Pit caused damage to her <br />property during a spring flood event. Mr. Baker contends that damage was done to both properties by actions at the <br />Bunn Ranch Pit. <br />The inspectors met with Elam and LaFarge representatives at the Bunn Ranch Pit. The inspectors inquired into what <br />information the pit operator would like to pass on that could help the Division in it's determination of events that <br />lead to complaint letter. The pit operator noted that much of the flood flow from the event in question went down a <br />parcel of land privately owned which is between them and the railroad tracks to the north. The railroad tracks act as <br />a berm which could prevent waters from going to the other side and impacting others. The flood waters threatened <br />their access to their pit as well as causing issues with water within their pit area as well. The pit operator did do <br />emergency tactics to prevent major damage to their pit on the private land between them and the railroad tracks with <br />the landowner's permission. The measures were mostly water diversion away from the access road which diverted <br />some water away road to a point where it re-entered the Ana Branch of the Yampa River. <br />The operator notes that construction of the berms along the river are within the permit boundaries and are for safety <br />as required by MSHA and to prevent waters from entering the permit area. Within the permit area, swales, ditches <br />and culverts gather waters and empty into the sedimentation ponds prior to release back to the river. Their opinion is <br />that several factors impacted everyone not just Mrs. Dewsnup and the Deakins Pit. The operator pointed out (2) 36" <br />and a 48" culverts north of the Dewsnup property that dump direct onto the property. Stormwater drainage from and <br />flood waters from along the state highway and railroad right of way flow directly onto the Dewsnup property and <br />then follow a Swale around the drive-in to the point where the erosion occurred. The spring flood that occurred <br />impacted lands from where the Ana Branch leaves the main channel of the river all the way down to where it ties <br />back into the Yampa. The primary reason for the unusual flow was an in stream berm within the river was <br />compromised and allowed additional waters to flow into the entire area. <br />The inspectors visited the engineer approved inlets and outlets for the pit area in the far south disturbance area. It is <br />quite clear that these structures are built very well and did their intended job of getting flood waters captured back to <br />the main stream. The structures are not part of any problem as they are some distance away from the main pit area <br />and deal with main channel issues. Reclamation of this area is very good with excellent vegetation and wildlife <br />habitat. <br />Analysis of the situation is ongoing. The inspectors at this time note no issues that directly or indirectly link their <br />activities to those that caused the impacts to the Deakins Pit or Mrs. Dewsnup. The inspectors requested that any <br />additional information that might be helpful be submitted by July 16, 2007. A Letter of Findings will be sent to all <br />
