III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />d~~ing the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Yoast Mine conducted on September 6, 2002 by Mike Boulay <br />and Sandy Brown of the DMG. Robert Shevling of Seneca Coal Comgany was present during <br />the entire inspection. Weather conditions were cleaz and warm. Ground conditions were dry <br />throughout the mine site. Coal was not being hauled from the mine site at the time of the <br />inspection. The dtagline was operating in the Yoast South Area. <br />Hydrologic Balance <br />Sedimentation Pond 010 was inspected. The pond has been drained and work is underway to <br />remove a lazge accumulation of sediment in the pond. Minor Revision No. 18 was approved on <br />August 26, 2002 for the construction of a temporary access road on the south side of Pond 010 to <br />allow trucks to haul the sediment to a pit area away from the pond. The road was viewed during <br />this inspection and appeazs to be constructed in accordance with the approved plan. <br />As discussed in the previous inspection report (see report dated 08/30/02), the road drainage <br />nmout formerly located at the outlet of Culvert D-4 has been removed and replaced by a berm. <br />The remedial repair plan for the landslide area below the Haul Road D embankment included a <br />provision for keeping as much runoff as practicable away from this portion of the road <br />embankment (above Pond 012). Breaching the berm and putting a drainage runout at the outlet <br />of Culvert D-4 will help reduce the amount of runoff to the slide location. Please consider <br />removing the berm in this location and reconstructing the former road drainage runout. The silt <br />fence associated with the drainage nmout below the D-4 outlet should also be repaired. <br />Topsoil <br />Topsoil redistribution has been completed on the southern side of the North Pit azea. All areas <br />that have been final graded and had topsoil replaced in the North Pit should be seeded this fall. <br />To ensure that the topsoil resource is not lost due to erosion, please seed all locations in the <br />North Pit that have had topsoil redistributed. <br />
