III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
This was a complete inspection conducted by Kent Gorham of the Colorado Division of
Reclamation, Mining, and Safety (Division). This former mountaintop removal operation is in
the final stages of completing reclamation. The site has achieved a Phase I bond release for
most areas. Ground conditions on this day were dry and the weather was mild and breezy.
Availability of Records
The public copy of the mine records is kept at the office of Peak Project Management (PPM).
The contact, address, and phone number for PPM is Ron Thompson, Peak Project
Management, 34115 County Road 20.8, Trinidad, CO 81082, 719-846-4975. Records were
found in compliance as detailed on page 2a of this report. The public liability insurance
certificate has been renewed since the last State complete inspection and expires February
8, 2008.
Roads
The Jeff Canyon haul road was smooth with no significant rutting or damage. Reclamation
of the widened sections of the road has been completed by removing the outside road berm
and ripping, mulching, and reseeding the road shoulder. This road has bee designated
permanent for industrial use to the point that it enters the mine disturbed area. Culverts and
road ditches appear functional and working, as designed.
Hydrologic Balance
Ditches along the steep slopes have been reshaped following the use of these ditch lines for
corridors to assist in the reseeding efforts. Outslopes of these ditches are now more
substantial and with revegetation nearing completion, storm runoff should be reduced (see
below).
