III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Reclamation, Mining, and Safety (Division). This former mountaintop removal operation is in <br />the final stages of completing reclamation. The site has achieved a Phase I bond release for <br />most areas. Ground conditions on this day were dry and the weather was mild and breezy. <br />Availability of Records <br />The public copy of the mine records is kept at the office of Peak Project Management (PPM). <br />The contact, address, and phone number for PPM is Ron Thompson, Peak Project <br />Management, 34115 County Road 20.8, Trinidad, CO 81082, 719-846-4975. Records were <br />found in compliance as detailed on page 2a of this report. The public liability insurance <br />certificate has been renewed since the last State complete inspection and expires February <br />8, 2008. <br />Roads <br />The Jeff Canyon haul road was smooth with no significant rutting or damage. Reclamation <br />of the widened sections of the road has been completed by removing the outside road berm <br />and ripping, mulching, and reseeding the road shoulder. This road has bee designated <br />permanent for industrial use to the point that it enters the mine disturbed area. Culverts and <br />road ditches appear functional and working, as designed. <br />Hydrologic Balance <br />Ditches along the steep slopes have been reshaped following the use of these ditch lines for <br />corridors to assist in the reseeding efforts. Outslopes of these ditches are now more <br />substantial and with revegetation nearing completion, storm runoff should be reduced (see <br />below). <br />
