III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection of the Yoast Mine conducted on November 20, 2002 by Mike <br />Boulay of the DMG. Lori Smith of Seneca Coal Company was present during the entire <br />inspection. Weather conditions were cloudy and cold. Ground conditions were partially snow <br />covered and very muddy. Coal was not being hauled from the Yoast Mine at the time of the <br />inspection. <br />Roads <br />Road surfaces throughout the mine site were wet and muddy. Haul Roads A, B, and portions of <br />D were accessible. Road ditches and road drainage runouts were muddy with some flowing <br />water, but generally well maintained. Haul Road D was not accessible beyond the location of <br />Culvert D-4, due to slick and muddy road conditions. <br />Hydrologic Balance <br />Sedimentation Ponds O10 and 012 were inspected. Pond 010 is still mostly empty after being <br />recently cleaned out. The surface of Pond 012 was frozen and the pond was full. Pond 012 was <br />discharging a small amount of cleaz water. <br />Backfill and Gradine <br />Reclamation activities including backfilUgrading and topsoil redistribution have recently been <br />completed in the far southern end of the Yoast South Area. These activities aze being conducted <br />contemporaneously with mining at this location. <br />Reveeetation <br />The temporary access road constructed for cleaning Pond 010 has been reclaimed (regraded and <br />topsoiled). This reclaimed azea should be seeded this fall. There is also one small area that <br />remains to be seeded located in the North Area pit. This is the former topsoil pile location east of <br />the Armand Draw crossing. To protect topsoil resources at these two locations, please seed these <br />azeas prior to the next inspection. <br />
