111. Comments - Compliance <br />Below are comments on the inspection. The comments include discussion of <br />ouservations mope during tiie inspection. Comments also descriue any <br />enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />On July 23, 1993 a partial inspection was conducted at the Apex No. 2 Mine. A <br />mine representative was not present. This mine was reclaimed last Fall. At the <br />time of the inspection the weather was cloudy and dry. The past several weeks <br />have been very dry and the recently revegetated areas show drought stress. <br />The reclaimed mine facilities area has been fenced since the last inspection. The <br />backfill at the former office area showed evidence of trespass grazing. The hay <br />bails anchored in the ephemeral channel had been eaten away. The mine <br />entrance sign had been pushed over. The corner of the erosion mat adjacent to <br />the mine entry sign had been peeled back about 6 feet, probably by cattle. The <br />mat should be anchored and the sign righted. The impacts of cattle In this <br />area are detrimental to successful reclamation; cattle can not be kept from <br />coming down the county road so this area should be fenced. If the sign is not <br />in the fenced area then it should be attached to a pole that will withstand <br />cattle. <br />The area of thistle in the northwest corner of the fenced In area showed <br />epinastic curling from the weed spraying last month. The county did the <br />spraying. Fanweed is very prevalent In the reclaim area. Weeds of the West <br />identified this plan as Field Pennycress (Thlaspi arvense L.). This weed looks <br />very much like Whitetop (Cardia draba (L. Des v. )), another mustard which is a <br />noxious weed of concern. Fanweed may have been brought in with the hay <br />mulch. According to the county, Fanweed is not of any concern and helps the <br />establishment of grasses. Unlike Whitetop it is an annual and will eventually be <br />crowded out by the grasses. <br />The bins were still on the county road right-of-way. The purchasers have not <br />yet removed them. Greg Lewicki (July 27, 1993 telephone) stated that he has <br />exhausted trying to get Pennsylvania West Coal Company to remove them and <br />would offer the bins to whom ever would remove them. The mine cars were still <br />at the former residence location, but portions of the bin have been cut up into <br />smaller pieces. The removal of these cars are part of the clean-up of prelaw <br />junk. The propane tank was still there. The pump house concrete foundation <br />must be broken up into smaller pieces and the edges of the culvert knocked in <br />and buried. <br />The culvert under Routt county road 29 and the access to the residence was <br />dented at the joining seam, 6 feet from the outlet. This caused a slight 3 inch <br />separation. Because of its location and size It will not impede flow. However. <br />the culvert should be repaired. <br />Apex No. 2 Mine July 23, 1993 <br />
