III. COMMENTS -COMPLIANCE <br />This was an aerial inspection of the West Elk Mine based on photos taken Tuesday, January <br />8, 2002. The weather was overcase. Active mining is going on, although the minesite itself <br />was relatively quiet. Drilling activity at the remote degas sites has ceased for the winter. <br />The roads all appeared to be in good condition. Roads up Sylvester Gulch were snow- <br />covered and icy. The roads around the methane degas holes also appear to be in good <br />repair. <br />All ponds were snow and ice-covered. There appears to be adequate freeboard on all ponds. <br />Topsoil pile at the NSSA (north soil storage area), and both Sylvester Gulch topsoil piles <br />were snow-covered, and show no evidence or instability or erosion. Topsoil piles at the <br />methane degas boreholes appear stable. <br />There was no evidence of any recent movement on the slope above the facilities area or in <br />any other location. <br />The refuse pile expansion area (RPA) showed evidence of recent addition of development <br />waste. The refuse pile appears to be nearly ready for a compaction event, as there are many <br />fresh piles of waste across the area. <br />
