III. Comments -Compliance
Below are comments on the inspection. The comments include discussion of
observations made during the inspection, Comments also describe any
enforcement actions taken during the inspection and the facts or evidence
supporting the enforcement action.
establishment of vegetation according to the approved reclamation
plan.
6. Roads must be maintained and protected from excessive erosion.
7. NPDES monitoring must be continued until removal of the sediment
control system.
8. When vegetation is successfully established the mine may apply for
removal of the sediment control structure.
The Division finds from this inspection that pollution of surface or
subsurface water is not occurring and that backfilling, regrading and
drainage control had been completed according to the approved
reclamation plan. The Division currently holds $90,000 and can release
60% or $54,000 in a phase 1 bond release. The Division estimates that
the remainder of the bond, $36,000, will be sufficient to complete the
remaining reclamation and to abate any pollution of surface or
subsurface waters. The Division estimates that it will cost $18,891 to
complete the reclamation as approved in the reclamation plan. The
Division's performance bond calculations are available for public review
at the Denver Office.
A copy of the bond release request is available at the County Planners
office in Grand Junction and at the Colorado Mined Land Reclamation
Division Office in Denver.
