<br />III. Comments -Compliance <br />Below are comments on the inspection. The comments include discussion of <br />observations made during the inspection, Comments also describe any <br />enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />establishment of vegetation according to the approved reclamation <br />plan. <br />6. Roads must be maintained and protected from excessive erosion. <br />7. NPDES monitoring must be continued until removal of the sediment <br />control system. <br />8. When vegetation is successfully established the mine may apply for <br />removal of the sediment control structure. <br />The Division finds from this inspection that pollution of surface or <br />subsurface water is not occurring and that backfilling, regrading and <br />drainage control had been completed according to the approved <br />reclamation plan. The Division currently holds $90,000 and can release <br />60% or $54,000 in a phase 1 bond release. The Division estimates that <br />the remainder of the bond, $36,000, will be sufficient to complete the <br />remaining reclamation and to abate any pollution of surface or <br />subsurface waters. The Division estimates that it will cost $18,891 to <br />complete the reclamation as approved in the reclamation plan. The <br />Division's performance bond calculations are available for public review <br />at the Denver Office. <br />A copy of the bond release request is available at the County Planners <br />office in Grand Junction and at the Colorado Mined Land Reclamation <br />Division Office in Denver. <br />
