III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was an aerial inspection that was flown on May 4, 2005. The digital images were reviewed on <br />May 9, 2005. The overflight of the mine site did not reveal any compliance problems. None of the <br />mine site areas had any snow cover. <br />West Mine <br />The backfilled and graded portal bench area was in good condition with no signs of slope instability or <br />erosional gullying. Vegetation is starting to come up. There was standing water in both sediment ponds <br />with a small quantity in the upper pond and a pool just below the primary pipe in the lower pond. Pond <br />embankments appeazed to be stable and the riprap outfalls were in place. <br />Unit Train Loadout <br />The three paved road entrances were dry, with no evidence of coal dust on the main highway. There <br />were no rail cars or coal haul trucks on site. The loadout site appeazed to be dry. No problems were <br />noted with any of the facilities. <br />East Mine <br />There was a moderate vegetative cover on the outslopes of the various mine benches. No problems <br />with slope instability or erosional gullying were observed at any of the cut or fill slopes. All of the <br />roads were passable. <br />The diversion ditch at the water tank bench was well grassed and had sufficient capacity. The top two <br />bin wall sediment ponds were intact and did not appeaz to have any standing water in them. <br />No erosional or slope instability problems were seen at the West Ridge waste pile. It did not appear <br />that there have been any recent additions to the waste pile. The vegetative cover was good. Collection <br />ditches were functional and there was some standing water in the sediment pond, although below the <br />level of the primary dischazge pipe. The old waste pile also had a good vegetative cover, with no signs <br />of slope instability or erosional gullying. <br />c:/word bowie 1 /insp0505 <br />
