III. COMMENTS - COMPLLANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. No one represented the operator <br />during the field inspection. <br />Roads <br />The paved haul road was in good condition. There was no cable across the top of the road. The bridge over the <br />North Fork of the Gunnison River was passable. The entrance gate was locked and the "no trespassing" sign was <br />up on the gate. <br />Signs and Markers <br />The post holding the mine ID sign was still on the ground. Surface disturbance markers were up around the <br />disturbed area, except for the area directly above the reclaimed portal area, due to the cliffs. <br />Facilities <br />There were no problems with the abandoned mine office building, except for its rundown condition. Both of the <br />building doors were open. <br />1~drology <br />The east side spring was flowing the usual orange color. The flow was contained in the ditch and culvert that <br />lead to the spring water treatment pond. The temperature of the spring water was 102 degrees Fahrenheit at a <br />point about 10 feet below where the spring appears out of the hillside. Tamerisk is reappearing in this location <br />and needs to be removed. There were no signs of any other springs at the mine site. No problems were observed <br />with the two alluvial wells. Well caps were on at both sites. <br />The water level in the sediment pond was about 1 foot below the primary discharge pipe. The primary and <br />emergency discharge structures were functional. The gated valve was closed. The pond embankment was stable. <br />The collection ditch leading to the pond was well vegetated and had sufficient capacity. The berm alongside the <br />river was functional as well. <br />The water level in the spring water treatment pond was about 6 inches below the horizontal pipe. The pond was <br />discharging about 20 gpm. The discharge was orange in color, which has been found to be in compliance. <br />Tamerisk has reappeared in the pond and should be eliminated. <br />Reclamation <br />No stability problems were noted with the reclaimed mine portal road. However, at the west portal area, the old <br />cracks are filling up, either naturally or through the operator's efforts. Unfortunately, new cracks are appearing <br />in the hillslope just east of and adjacent to the old crack area. There was no odor of smoldering coal in this area. <br />There were scattered occurcences of thistle on the reclaimed hillside and should be sprayed. <br />c:/word/bear3/insp0706 <br />
