III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of Minerals <br />and Geology. This former underground mine was reclaimed and reseeded in 1996 and early <br />1997. Ground conditions on this day were excellent and the weather was mild for the fall <br />season. <br />Signs and Markers <br />White PVC pipe markers the perimeter of the reclaimed areas. These markers are in <br />compliance with the requirements of Rules 4.02 regarding marking the perimeter of the <br />disturbed area for underground mines. The operator is reminded that these markers should <br />remain until any final bond release inspection is completed and should be removed prior to <br />final approval of the subject bond release. <br />Revegetation <br />The growing season is effectively over at this site due to mild frost and shorter days. Litter <br />cover from this year's growth is excellent. Trespass grazing has been a problem in the past <br />but was not observed this field season. The operator will likely conduct vegetation sampling <br />next year as 2005 will be the ninth growing season for a large portion of the reclaimed area <br />at this site. <br />Offsite Support Facilities <br />Ron Thompson of Peak Project Management indicated that work at the NW-1 ventilation <br />shaft might commence on November 1, 2004. Norwest Consultants of Salt Lake City will be <br />the project manager of this work. Mr. Thompson indicated that the landowner has been sent <br />written notice that this work is eminent. Please provide the Division with the dates that this <br />work will be completed as soon as they are finalized. <br />Overall, the site appeared in excellent condition for the fall season. The operator is <br />reminded to please complete repair of the reference area fence this field season. <br />
