III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DRMS. No one represented the <br />operator during the field inspection or records check. <br />Reclamation <br />The reclaimed mine slopes and backfilled highwall appeared to be stable. No slumping or cracking of the <br />backfilled material was observed. No wet areas from seeps were evident and there were no erosional problems. <br />The vegetative cover was very good. The operator sprayed some thistle that had been growing in the area where <br />the black culvert goes into the pond 5 collection ditch. The reclaimed benches were stable and well drained. The <br />black culvert that brings upper bench runoff down to the pond 5 collection ditch was in place. The north <br />underdrain had drops of water coming out of it but the other two underdrains were dry. <br />The reclaimed haul road was also stable. The reclaimed coal stockpile area had a good vegetative cover. There <br />were no erosional problems at either of the two sites. <br />Hydrology <br />Pond 4 was dry. The pond embankment was well vegetated and pond spillways were operational. The road <br />culvert that takes runoff from the reclaimed coal stockpile area to the pond had sufficient capacity. The upland <br />diversion ditch at the reclaimed coal stockpile area had sufficient capacity and was well vegetated. <br />Pond 5 was also dry. Pond spillways were operational. The collection ditch leading into pond 5 had sufficient <br />capacity and a good vegetative cover. <br />Roads <br />The Hubbard Creek county road was dry and in good condition. The access road that goes across Hubbard <br />Creek and leads to pond 5 was passable. The front gate was locked. <br />Signs and Markers <br />The mine ID sign and "records location" sign were on the front gate. Surface disturbance markers were up, <br />although a few more to better define the area would be helpful. <br />Records <br />The records are located in the Delta County Clerk and Recorder's Office in Delta.
