III. COMMENTS -COMPLIANCE <br />Colovryo C-1981-019 <br />23 October 2006 ~~ <br />Pg 1/7 <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Colowyo Mine conducted by Jim Stark of <br />CDRMS. The inspection was conducted on 23-25 October 2006. Records were <br />checked on the morning of 24 October 2006. Tony Tennyson accompanied me on <br />24 and 25 October. Tay Tonoai and Kurtis Blunt were also present on the afternoon of <br />24 October 2006 to discuss worst-case disturbance and the floating bond concept <br />and their relation to Technical Revision bb. The mine was actively mining coal and <br />hauling coal to the loadout at the time of the inspection. A train was being loaded <br />on the morning of 25 October 2006. The weather was cold and overcast and the <br />ground was wet and muddy. <br />While at the Colowyo Mine the operator hand-delivered Minor Revision 85. Minor <br />Revision 85 addresses a CDPHE minimal discharge permit and is discussed under <br />hydrologic balance. <br />Availability of Records: -The records were checked on the morning of 24 October <br />2006. All of the necessary were available at the mine's office. See the DMG <br />Availability of Records checklist attached at the end of this inspection report for more <br />details. <br />Signs and Markers: -All of the necessary signs (including mine ID signs, disturbed <br />boundary signs, stream buffer signs and blasting signs were in place as required and <br />contained all of the necessary information. <br />Roads: -The access road and haul road to the Gossard Loadout is a paved road. <br />The road was well maintained and in good condition. <br />-The light-use road in Taylor Draw to the West Pit and East Taylor ponds was muddy <br />and slightly rutted at the time of the inspection. There were pools of water at the low <br />spots of the road. The road was stable and overall in good condition at the time of <br />the inspection. <br />-The haul roads in the East and West pit areas were all well maintained and stable at <br />the time of the inspection. The roads were dry due to the heavy use but there was no <br />problem with fugitive dust at the time of the inspection. No erosional problems were <br />noted on these roads. <br />-The road to the East Pit area where the 101 dragline is working was muddy and <br />rutted at the time of the inspection. The low-spot of the road was not passable at the <br />time of the inspection due to mud and water. The road was stable overall. The road <br />will need to be graded once it dries up. No erosional problems were noted on the <br />road. <br />
