COMMENTS -COMPLIANCE <br />Below are comments on the inspection The comments include discussion of observations made <br />during the mspectmn Comments a~so describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action <br />This was an aerial inspection flown by Harry Ranney of the Colorado Division of <br />Reclamation, Mining. and Safety (Divisron) Oblique aerial photographs were taken on <br />September 25, 2007 and reviewed in the office by Kent Gorham of the Division on <br />September 26. 2007. Deserado is an active underground mine that produced in excess of <br />1 6 mdhon tons of coal rn 2006 Recently, spontaneous combustion concerns have idled the <br />mine until those concerns can be resolved. <br />Various sediment ponds <br />at the rnam facility area <br />and at the refuse area <br />appeared to hold a <br />moderate amount of <br />water, indicating the site <br />has received some <br />precipitation over the last <br />few weeks. (see photo at <br />right) <br />The refuse area consists <br />of a number of separate <br />refuse piles. It appears <br />that all stockpiled refuse <br />has been spread and <br />compacted <br />A train was visible at the <br />unit train loadout and 4vas <br />likely being loaded with <br />coal. Topsoil pries <br />appeared vegetated and <br />stable with no evidence of <br />disturbance or damage <br />due to slumps or erosion <br />The main facility area <br />appeared in orderly <br />condition with nothing <br />unusual noted. <br />Nothing warranting <br />immediate on-the-ground <br />inspection was noted <br />
