III. COMMENTS COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Tom Kaldenbach of the <br />Colorado Division of Minerals and Geology. Rick Mills represented the <br />operator during the field portion of the inspection. <br />More than a foot of snow cover hindered inspection. <br />The longwall is active in panel 13 Right, south of Fish Creek. <br />SIGNS AND MARKERS <br />Topsoil markers were properly displayed at the NMD vent shaft <br />construction site. <br />Hydrologic Balance <br />Fish Creek Borehole (COPS Permit CO-0042161, Outfall 001) - There was no <br />discharge. No problems were found at the site. <br />Support Facilities <br />Progress on recently approved projects: <br />Northern Mining District Vent Shaft (TR-39) - The air drill rig <br />and work crew were working. Holes have been drilled to the <br />Twentymile Sandstone just outside the perimeter of the vent shaft <br />(which is yet to be drilled). The holes are for grouting the <br />Twentymile Sandstone to prevent water inflow into the vent shaft. <br />The raised bore drilling equipment is expected to arrive in a few <br />days. Although frozen now, surface drainage on the construction <br />site is routed to a sediment trap that has a rock filter at its <br />outlet. <br />Rerouting of discharge from old pit, south of pond D (TR-39) - <br />There was no activity on the site. The pump has been installed on <br />the steel platform on the north bank of pond D. The desander <br />building is completed. <br />Yampa Valley Electric Capacitor Bank {MR-174) - Concrete footings <br />have been installed. There was no activity on the site. <br />Subsidence <br />The subsided section of County Road 33 was in good shape. <br />3 <br />
