A site inspection of the Rocky Flats Pit was conducted in response to a complaint <br />recently received from Jim Lile of Jefferson County regarding a weed infestation of Diffuse <br />Knapweed at permitted mine sites north of Colorado State Highway 72 and west of the Rocky <br />Flats Technology Site. Present during the inspection were Charles McKay of Church Ranch, Tom <br />Murray of Lakewood Brick & Tile Co., Jim Lile of Jefferson County, and Steve O'Brian of <br />environment, Inc. <br />2. Rule 3.1.10(6) of the Construction Materials Rules & Regulations specifies that "Methods <br />of weed control shall be employed for all prohibited noxious weed species, and whenever <br />invasion of a reclaimed area by other weed species seriously threatens the continued <br />development of the desired vegetation. weed control methods shall also be used whenever the <br />inhabitation of the reclaimed area by weeds threaten further spread of serious weed pests to <br />nearby sites." <br />3. The site inspection revealed that there is an on-going chemical weed control program for <br />diffuse knapweed at the site by the surface owner, the U.S. Department of Energy. The Rocky <br />Flats Pit site remains undisturbed by mining. The chemical weed control program appears to <br />be effective as the percent cover by diffuse knapweed is significantly less than on adjacent <br />disturbed land. Diffuse knapweed is considered to be a noxious weed within the State of <br />Colorado as defined by the Colorado Noxious Weed Control Act 35-5.5-101 through 119, <br />C.R.S. (1996 Supp.). Mr. McKay indicated that the Church Ranch is cooperating with the <br />surface owner (Department of Energy), Jefferson County, and adjacent landowners in developing <br />an integrated weed control plan for diffuse knapweed for the Colorado Highway 93 corridor <br />between Golden and Boulder. <br />4. Review of the permit file for the Rocky Flats Pit indicates that there is no weed control <br />plan in the permit for noxious weeds such as diffuse knapweed. The need for incorporating <br />a weed control plan into the mining and reclamation plan and implementing the plan until the <br />site is adequately reclaimed was discussed with the operator. <br />5. The Division considers the current infestation of diffuse knapweed at the Church Pit, <br />although under control, to be an indication that diffuse knapweed may also.l~ecome a problem <br />during the mining and reclamation phases of the operation. In order to bring the permit into <br />compliance with Rule 3.1.10(6), the operator must submit an application for a technical <br />revision to the permit which addresses control of diffuse knapweed and any other weeds which <br />may be encountered, and ensure that the plan is implemented. The application fora technical <br />revision should be submitted to the Division within 60 days.
