PAGE 3 <br />SEPTEMBER 29, 2006 ~ , <br />physical characteristics of the shale, into which the wash pond <br />was duq, can not be a water bearing strata and the geology of the <br />area shows that the groundwater table is east of the.wash ponds. <br />The test hole excavated in the immediate vicinity of the wash <br />ponds contained no ground water so one can presume that groundwa- <br />ter has not been exposed in these ponds, We believe that the <br />information presented in this letter provides the demonstration <br />the Division needs to determine that PB #1 has been resolved <br />before the October 23, 2006 deadline. <br />I would like to have a written response from the Division to give <br />to Grand County for the record if you concur that we are in <br />compliance with Rule 3.1.6(1).
