ORIGINAL - POBLIC FILE <br />(Page 2j <br />MINE ID # OR PROSPECTING ID #: rv+-tan-5~~ <br />INSPECTION DATE: 6/t~/n~ INSPECTOROS INITIALS: ~- <br />OBSERVATION <br />The Division conducted a pre-operational inspection of the site on <br />6/17/06.The site is an old 112 sand and gravel operation located in Adams <br />County. Present during the inspection was Mr. Steve O'Brien, the consultant <br />to the operator. On April 12, 2006 the MLRD BOARD found Albert Frie and <br />Sons to be in violation of the approved permit for permit # M-1977-526, <br />Worthing PIT, for placing a slurry wall with out first submitting an <br />amendment application to the permit and obtaining approval from the <br />Division. The Board fined the operator $13,500.00, of which $12,500 was <br />suspended as long as the operator submitted an amendment to cover the <br />slurry wall and obtain an approval from the Division with in 180 days. The <br />existing site was not inspected at the time of the inspection, except as an <br />over all site cursory inspection. The main purpose of the inspection was to <br />verify that indeed the slurry wall was in place as reported by the <br />operator. Amendment was submitted on April 10,2006 prior to the MLRD BOARD <br />DATE. <br />The Division verified that the slurry wall was in place, during the <br />inspection and requested the operator provide the certification of <br />acceptance from the State Engineer Office. Until such proof is provided, <br />the Division will have no choice but to request the full warranty to be <br />posted for the slurry wall rather than the 20%, for maintain ace, as <br />required by DMG POLICY.
