Mr. Gary Snook indicated during a January 29, 1997 telephone conversation that BMI- <br />France intends to maintain their clay lease at the site; however, they are not interested in <br />permitting the entire disturbed area. <br />7. The native vegetation in the area includes a pinyon-juniper overstory and a shortgrass <br />prairie understory dominated by blue grams grass. The estimated ground cover in the adjacent <br />undisturbed areas is approximately 70t with 30t remaining as bare ground. <br />8. During the inspection various areas of the operation were investigated. Mr. Mueller <br />admitted to disturbing all of the 22.0 acres in question with the exception of the clay <br />stockpiles and the pre-1976 pit. The pre-1976 pit area was used only as an access way to the <br />active pit to the southeast. Active disturbances outside the 9.9 acre permit area vary from <br />light to significant and are described below: <br />a. Topsoil Stockpiles - light disturbance 1.6 acres <br />b. Slab Rock Exposed - moderate disturbance 0.5 acres <br />c. Active Pit Area - significant disturbance 0.2 acres <br />d. Slab Rock/Pallets - light disturbance 4.0 acres <br />e. Clay Stockpiles - light disturbance 0.7 acres <br />f. Access Road/Storage - light disturbance 2.0 acres <br />g. Overburden Storage - moderate disturbance 4.5 acres <br />h. Northwest Area - moderate disturbance 1.0 acre <br />i. Pre-1976 Pit - light disturbance 1.0 acre <br />-- <br /> Total .................................. 15.5 acres <br />9. The 9.3 acres of light disturbance will require seedbed preparation and revegetation. <br />The 6.0 acres of moderate disturbance will require light grading, seedbed preparation, and <br />revegetation. The 0.2 acres of significant disturbance may require blasting, regrading, <br />seedbed preparation, and revegetation. <br />10. Within the permitted area there is approximately 6.5 acres of disturbance of which 6.0 <br />acres will require regrading, seedbed preparation, and revegetation. Approximately 4.0 acres <br />consists of the active pit area which may also require blasting to reduce the highwall. <br />11. The active pit consists of an upper bench and a deep trench. Topsoil and alluvium has <br />been excavated to a depth of 8 feet. The operator has exposed a level bench approximately <br />75 feet wide x 450 feet long. The deep trench is approximately 250 feet wide x 450 feet long <br />x 25 feet deep.
