III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion.of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the lospection <br />and the facts or evidence supporting the enforcement action. <br />This aerial inspection was flown on Mazch 3, 2005 and the digital images were reviewed on March 7, 2005 <br />During the overflight, no problems with compliance issues were noted. Most of the site was clear of snow. <br />Coal Waste Piles <br />There was no activity at coal waste pile no. I. The top of the pile had been graded and appeared to be wet in <br />spots but there was no evidence of any ponding of water. The upland diversion ditch appeazed to be functional. <br />The coal waste pile no. 2 haul road was in good condition. <br />There was considerable activity at the coal waste pile no. 2. Two excavators, two dozers and three dump trucks <br />were working the pile. Additional pieces of equipment were standing by on the pile. The extreme east end of the <br />pile still had piles of coal waste. The rest of the pile was graded. There was no ponding of water on top of'the <br />coal waste pile no. 2. There was some water in Pond F but not a lot. Pond F has a pump for discharging water, <br />rather than a primary dischazge tube. The Pond F embankment appeared to be stable. <br />There was a moderate volume of water in both Pond C and Pond D. The haul road to the coal waste pile sites <br />appeared to be wet but in good condition. No problems were noted with the material storage sites along this <br />-' ,length of road. <br />Main Mine Site <br />There was a moderate amount of coal on the main coal stockpile bench next to the main highway. No problems <br />with fugitive dust from the coal stockpile were observed. It appeazs that a small amount of coal had been tracked <br />onto the main highway by coal haul trucks but it did not appear to be a problem. <br />The operator has placed mulch blankets on most of the cut slope behind the wash plant. The operator did not <br />place these blankets on the section of slope that had a previous slump. Other cut and fill slopes were stable. <br />There was a moderate volume of water in Pond B. The pond embankment appeazed to be stable. The two <br />collection ditches that enter Pond B on the east side and on the west side appeared to have enough capacity. <br />No problems were noted with the conveyor and transfer system structures and with the material storage areas at <br />the mine site entrance and next to the main topsoil stockpile and at the D-seam portal bench area. There were no <br />signs of slope instability'or slumping at the main topsoil stockpile. The main haul road was in good condition. <br />The operator is neazing completion of the construction of the conveyor system that will bring coal from the B- <br />seam portal bench up to the D-seam portal bench, for crushing and screening and loading• onto the downhill <br />conveyor. The small slide of rocks in the upper section of the B-seam portal bench outslope does not appeaz to <br />have grown in size. No problems were noted with the D-seam portal bench or the water tank bench. Only a <br />small amount of coal was stockpiled on the D-seam portal bench.
