Pugh <br />The Burlington Northern Railroad Loadout Area of this permit <br />was inspected for Phase I, II, and III bond release on <br />November 30,1993. The weather was sunny, windy and cool. The <br />State had conducted an inspection previously, so no State or <br />Company representatives were present. Photos and a video of <br />the site were taken. <br />According to Dan Hernandez, Colorado Division of Minerals and <br />Geology, the City of Trinidad is in the process of making the <br />loadout part of a sludge disposal area. The approved <br />postmining land use is for industrial use but would need to be <br />revised and approved by the Regulatory Authority (RA) for the <br />more sp.:cific use of sludge disposal. Since an industrial <br />postmining land use requires that the site be vegetated not <br />less than that required to prevent erosion, the City would <br />have to be in the process of applying sludge at this time to <br />~,~~~.>Tc ~ the requirement for vegetation and qualify for Phase II <br />bond release. A Notice of Violation (NOV) was issued 6-10.-9.3 <br />for the lack of drainage control. It has been extended to 11- <br />30-93. The site still had no drainage control in place at the <br />time of inspection. -Add3tianal3y; a~arge=~rovr~-of earth ----- -- --- --- <br />remains on the southern end of the loadout area which would <br />need to be regraded or removed before Phase I bond release can <br />be granted. <br />At this time the site is not ready for Phase I, IZ, or III <br />bond release. <br />3 ~-3 <br />
